Introduction

Text2Sale ("we", "us", "our") operates a mass-texting CRM platform ("Service") that enables Users to send SMS, MMS, and related communications to their contacts. This Privacy Policy describes what information we collect, how we use it, when we share it, and the rights and choices available to individuals whose information we process.

By accessing or using the Service, you agree to this Privacy Policy and the Terms and Conditions. If you do not agree, you must not access or use the Service.

Scope and Roles

When our customer ("User") uploads contact data and sends messages, the User is the "controller" or "business" with respect to that contact data, and we act as a "processor" or "service provider" acting on the User's behalf. We are the "controller" with respect to account information we collect directly from Users.

Users are solely responsible for ensuring that the contact data they upload and the messages they send comply with all applicable laws, including obtaining appropriate consent from recipients and honoring opt-out requests.

Information We Collect

Information you provide directly: account profile data (name, email, phone, password hash), billing data (processed by our payment processor; we do not store full card numbers), contact lists and other content you upload, and any information you submit through support or marketing interactions.

Information collected automatically: IP address, device and browser type, operating system, access times, pages viewed, clicks, referring URL, and approximate geographic location derived from IP address. We use cookies, local storage, and similar technologies to operate and secure the Service.

Messaging data: message content, recipient phone number, send time, delivery status (queued, sent, delivered, failed), and reply content. Delivery events are received from carriers and aggregators and retained to provide analytics and support.

Third-party data: information provided by carriers, registries (including A2P 10DLC), aggregators, payment processors, and identity or fraud-prevention partners.

How We Use Information

We use the information we collect to: (a) provide, operate, maintain, secure, and improve the Service; (b) transmit messages as directed by Users; (c) process payments and manage billing; (d) communicate with Users about their accounts; (e) monitor for and prevent fraud, abuse, and violations of the Terms; (f) comply with legal obligations and enforce our agreements; and (g) develop new features and aggregated analytics.

Legal Bases for Processing (EEA/UK Users)

If you are located in the European Economic Area, United Kingdom, or another jurisdiction recognizing equivalent rights, we process your information based on one or more of the following legal bases: performance of a contract with you; compliance with a legal obligation; our legitimate interests in operating and securing the Service; and your consent, where applicable.

How We Share Information

We do not sell personal information. We share information with: (a) messaging carriers and aggregators (such as Telnyx) to deliver messages; (b) payment processors (such as Stripe) to handle billing; (c) cloud hosting and infrastructure providers; (d) AI model providers, solely to the extent necessary to generate features you have enabled; (e) auditors, advisors, and professional service providers under confidentiality obligations; (f) law enforcement, regulators, or other parties when required by law or to protect rights, safety, or property; and (g) successors in the event of a merger, acquisition, financing, or sale of assets, subject to standard confidentiality terms.

User-Uploaded Contact Data

Users are responsible for the lawfulness of every contact record they upload and every message they send. Text2Sale does not independently verify consent, opt-in status, or eligibility for any recipient. You — as the User — warrant that you have obtained all necessary consents and that your use of the Service complies with all applicable law.

If you are a recipient of a message and wish to opt out, reply STOP to the message or contact the sender directly. Because the sender controls its contact list, requests to remove a phone number from a specific User's list must be directed to that User.

Data Retention

We retain account information for the life of the account and for a reasonable period after account closure to comply with legal, tax, and regulatory obligations, resolve disputes, and enforce our agreements. Messaging data is retained consistent with carrier, aggregator, and regulatory requirements and to support analytics, support, and compliance functions.

Users may request deletion of their account by contacting support@text2sale.com. Some information may be retained in backup systems or where required by law.

Security

We implement commercially reasonable administrative, technical, and physical safeguards designed to protect information against unauthorized access, disclosure, alteration, or destruction, including encryption in transit, encryption at rest where supported, access controls, logging, and periodic review. Despite these measures, no system is completely secure; you transmit information at your own risk.

Your Rights and Choices

Depending on your jurisdiction, you may have rights to access, correct, delete, port, or restrict the processing of your personal information, object to certain processing, withdraw consent, and lodge a complaint with a supervisory authority. California residents: Under the California Consumer Privacy Act (CCPA/CPRA), you have the rights to know, delete, correct, and opt out of the sale or sharing of personal information. We do not sell personal information as defined by the CCPA.

We will not discriminate against you for exercising any of these rights.

International Data Transfers

The Service is operated from the United States. If you access the Service from outside the United States, your information will be transferred to, stored in, and processed in the United States and other countries, which may have data protection laws different from those in your jurisdiction. By using the Service you consent to such transfer.

Children's Privacy

The Service is intended for individuals aged eighteen (18) or older. We do not knowingly collect personal information from children under 18. If you believe we have collected information from a minor, contact support@text2sale.com and we will delete it.

Third-Party Services

The Service integrates with third-party providers, each of which operates under its own privacy policy. We are not responsible for the privacy practices of any third party. Please review the policies of any third party before providing information to them.

No Liability Upon Company for User Messaging

As described in the Terms and Conditions, every message transmitted through the Service is sent at the User's direction and sole responsibility. Text2Sale bears no liability for the content, recipients, timing, consent status, or legal consequences of any such message. Recipients who believe their rights have been violated must address their concern to the sending User.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Material changes will be announced through the Service or by email. The revised policy takes effect as of the posted Effective Date. Continued use of the Service after an update constitutes acceptance of the revised policy.
